SARFAESI and DRT Lawyers in Bangalore
If a bank or financial company has issued a SARFAESI notice, taken possession of your property or filed a recovery case, we can help. We act for borrowers, guarantors and property owners before the Debts Recovery Tribunal (DRT), the DRAT and the High Court.
Overview
Protecting your property in bank recovery cases
Under the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (SARFAESI Act), banks can take possession of mortgaged property and sell it without going to court. The law also gives borrowers rights and strict time limits to challenge these steps.
We review the bank’s notices, the loan documents and the valuation. We then advise on a reply, a Section 17 application, a settlement or other remedies.
